Today I finished my 2-day Accredited Buyer Representative (ABR) Class. Our class of around 40 REALTORS® discussed a lot of legal and ethical issues. The biggest discussion was this morning when we discussed how to ethically handle a situation where you have 2 different clients who both want to make offers on the same property. Some of the agents clearly weren’t comfortable with representing both clients, but when we discussed the alternatives, we realized that to do anything else would cause more issues. The key is maintaining the confidentiality of both clients. You can’t tell either one that another client of yours is also making an offer on the property since that would be violating the duty of confidentiality to the other client.
Home buyers and potential home buyers, I’m interested in your thoughts on this. Does this surprise you? Would you be upset, if you later learned that your offer lost to an offer by another client represented by your buyer’s agent?
