When in doubt, disclose even though IL real estate laws not as strict as CA

Wild Partiers :)Inman News which covers the real estate industry recently reported the story of home buyers in California who are suing their sellers for not disclosing known noise issues. California has stricter real estate disclosure laws than here in Illinois. In California home sellers are required to disclose “known neighborhood nuisances, noise issues (including parties), and notifications of government officials for problems”.

According to the buyers, a group of 6 renters across the street throw wild parties 3 to 4 times a week. Some parties start in the early morning hours.

The buyers discovered that not only did the sellers fail to disclose knowledge of the noise problem; they had written numerous letters to the landlord and tenants and had called the police on several occasions.

Illinois real estate disclosure laws may not be as strict, but home sellers should take them just as seriously or risk getting sued.
